Resumo
Na América Latina, a ascensão da resolução alternativa de disputas (ADR) surgiu como uma solução viável para as deficiências do sistema judiciário tradicional, que muitas vezes é caracterizado como caro, burocrático e lento. A busca por abordagens mais eficientes e econômicas para a resolução de disputas tem despertado o interesse pelos métodos de ADR.
O objetivo deste estudo é fornecer uma análise abrangente dos métodos alternativos de resolução de disputas, explorando suas definições, características, vantagens e desafios, com foco em suas aplicações no direito internacional global e em algumas histórias de sucesso na região. O problema de pesquisa se concentra em saber se o alto custo econômico e de tempo do litígio impulsionou o sucesso e a rápida adoção desses métodos.
Este estudo emprega uma abordagem qualitativa e analítica, com base em uma revisão da literatura e em estudos de caso de vários países latino-americanos. Os resultados mostram que a ADR oferece vantagens significativas, como rapidez, custo-benefício e preservação de relacionamentos, embora sua adoção tenha sido desigual na região. A eficácia dos ADR na região requer um equilíbrio delicado entre a voluntariedade e a aplicação obrigatória, bem como uma clara delimitação de papéis e poderes de decisão entre as partes envolvidas e o judiciário. Em suma, a ADR provou ser uma oportunidade valiosa para a região, e seu futuro parece ainda mais promissor.
