Abstract

The injurious action is a legal tool that allows the administration to infirm its own will, in cases where it is contrary to the legal system superior or harmful to its own interests. Through a combined legal, jurisprudential and doctrinal vision, it is intended to address the issue of the origin of this legal instrument in the contractual activity of the State, specifically against the separable act of adjudication, allowing a clear differentiation of the events in which the administration can act by itself by means of the direct revocation of the act or when it must necessarily go to the judge of the contract in search of its pronouncement, to try to condemn the harmful effects of the decision itself.
